Terms & Conditions

Your contract is with Swim on the Wild Side Ltd a company registered in England with Company Registration Number 9961759 and having its registered office at Sunny Grove, Millbeck, Keswick, Cumbria CA12 4PS.

Swim on the Wild Side Ltd agrees to provide all services offered on this website subject to the following terms and conditions. All terms and conditions are accepted by all the participants once a deposit is made.

All tours and prices are subject to change and availability.

Bookings/Deposits

For all Day and Half Day tours, payment in full is required upon confirmation of a booking, of which £25.00 is regarded as a non-refundable deposit after 14 days. Swim on the Wild Side Ltd cannot confirm any booking until payment is received in full and reserves the right to cancel any reservation for which the total price has not been paid by the date due in which case the deposit will be forfeited.

Tours such as The Great Lakes Swim Tour, The BREXIT Challenge and others, out with the Day and Half Day Tours, will have their own deposits set, determined by the overall cost of the tour and will be explained in full by email beforehand.

Payment

All holidays should be paid for by sterling cheque or bank transfer in GBP sterling (£). All bank charges are the clients responsibility and must be settled, in full, when making payment.

Swim Tour Price Adjustments/Changes

Swim tour prices quoted are subject to adjustment prior to full payment in the event of changes in VAT, fuel prices, exchange rates or hotel changes. Prices are quoted based on a quoted number of people, any change in the number of people may affect the price.

Adjustments or Changes

Swim on the Wild Side Ltd reserves the right to make minor adjustments to the itinerary and reserves the right to cancel any holiday prior to start (departure). In the event of Swim on the Wild Side Ltd cancelling a holiday, all payments including deposit will be refunded in full.

Cancellation Policy

Cancellations due to any reason are only effective on receipt of written notification and in such instances, from time of booking up to 61 days prior to commencement of tour the full deposit is forfeited.

If the cancellation is made 60 days or less to commencement of tour, the following charges will apply to recover holiday costs:
≥60 days prior to commencement of tour: the full deposit will be forfeited
30-59 days prior to commencement of tour: 70% of the holiday cost will be forfeited outwith the forfeited £25.00 deposit
29 days or less prior to commencement of tour: 100% of the tour holiday will be forfeited
Not turning up: 100% of the holiday cost will be forfeited.

Trip Cancellations/Medical Insurance

We insist all clients to take out adequate insurance against all possible risks including medical, personal injury, death, loss of baggage, theft etc.

Refunds

Once the holiday has commenced, refunds will not be made for unused or partially used portions of the booked itinerary.

Visas & Vaccinations

Visa and immunisation requirements vary from country to country and up-to date information should be obtained from your local health department and consulate. It is the responsibility of the visitor to ensure that they have a valid passport and the correct visas and that they have the required vaccinations to gain entry to any country, which they are intending to visit.

Health & Dietary Requirements

We highly recommend that travellers check health regulations with their General Practitioner well in advance of departure.

Prices Do Not Include

Prices do not include flights & airport taxes, fuel, telephone calls, laundry, or any sightseeing or entertainment arrangements not specified in the itinerary. All meals, drinks, equipment hire, or any other personal items are not included unless specified when booking.

Travel Documents

Should travel documents (itineraries, vouchers, brochures etc.) of any kind be couriered or mailed to clients, the client will incur any costs.

Holiday Flights

It is the responsibility of the client/traveller to ensure that they are able to meet any departure times for flights.

Airline Delays

Arrival delays and lost baggage charges are beyond our control. We are therefore not responsible for associated delays or costs.

Responsibility

Swim on the Wild Side Ltd, its operators of the holiday and/or suppliers of services act only as agents in regard to swimming, accommodation, entertainment and travel arrangements, whether by plane, sea, car, train or motor coach and therefore Swim on the Wild Side Ltd assume no liability for injury, damage, loss, accident, delay, war, revolt, or other civil uprising, other military action, strikes or any Act of God occurring in the destination of the Holiday or through passage, or for any reason whatsoever, or through the acts or default of any company or persons engaged in conveying the passengers or in carrying out arrangement of the holiday. They cannot accept any responsibility for losses or additional expenses due to delay or changes in air schedules or other causes. Swim on the Wild Side Ltd may not be held responsible for any theft, loss or damage to baggage, hired vehicles, hired equipment or other items or personal effects during the tour program. Once deposit is made all of the above conditions will be deemed as accepted by the client(s).

Disclosure

Please be aware that during your participation in this holiday, certain risks and dangers may arise including but not limited to the hazards of travel by boat, train, automobile, aircraft or other means of conveyance, the forces of nature, and political unrest. Also be aware and clearly understand that Swim on the Wild Side Ltd will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Swim on the Wild Side Ltd will use all reasonable efforts to ensure that all adequate measures are taken to avoid such occurrences. By acceptance and payment of the Swim on the Wild Side Ltd holiday you are a voluntary participant in these activities with the knowledge of the dangers involved and hereby agree to accept any risks. As Lawful consideration for the agreement with Swim on the Wild Side Ltd to participate in such trips and activities, you hereby agree that you will not make a claim against Swim on the Wild Side Ltd and its employees or Agents for all claim actions and demands you may have for bodily injury, death or property damage arising from your participation in a holiday. Acceptance of the Holiday Contract will serve as the release of Liability and Assumption of Risk Agreement. This agreement is binding on your heirs, legal representative and assigns. If any portion is unenforceable, the remaining portions shall remain in full force and effect.

8 Severance
